IN THE NAME OF GOD, AMEN, the fifteenth day of July anno domini 1628 and in the year of the reign of our sovereign Lord Charles by the grace of God the King's mercy that now is of England, etc, the fourth, I, NICHOLAS HICKS of the parish of Paul in the County of Cornwall, yeoman, being reasonable well and healthy in body and perfect of mind and memory thanks be given to God considering that all persons whatsoever living in this laish [sic] stage of worldly mortality are subject unto death which is certain although the manner, time and place most uncertain, do therefore with such portion of goods and blessings as the Lord hath bestowed upon me his poor and unprofitable servant and steward make, declared and ordain this my last Will and Testament in manner and form following, First I give, bequeath and commend my soul into the hands of my heavenly father whensoever it shall please his blessed will to take it out of this prison of flesh and my body to the earth whereof it is made hoping assuredly by the merits, death and passion of my only Lord and Saviour Jesus Christ to be made partaker by a true and lively faith of life everlasting. Item, I give and bequeath for tithes forgotten five shillings. Item, I give and bequeath to the poor of the town and parish of St. Ives thirty shillings and to the poor of the parish of Paul twenty shillings and to the stock and store of each parish twenty shillings a piece. Item, I give and bequeath to my cousin HENRY HICKS six pound being part of the debt which he oweth unto me by his bill or specialty. Item, I give and bequeath unto my cousin GEORGE HICKS forty pounds being parcel of the debt which his deceased father and himself stand bound unto me by their Bill or specialty. Item, I give and bequeath to my cousin RICHARD HICKS seven pound being part of the debts which he oweth unto me as well by his Bill or specialty as also by Deed or writing concerning his Court or Curttage. Item, I give and bequeath unto my cousin deceased JOHN HICKS his son late of Plymouth ten pound to be paid unto his son when he shall accomplish the age of seventeen years and if he happen to die before the said age then I give and bequeath the same unto my Executrix and children. Item, I give and bequeath to my brother JOELL HICKS his son and my godson NICHOLAS HICKS forty shillings. Item, I give and bequeath to my cousin JOHN HICKS twenty shillings and to his brother RICHARD HICKS twenty shillings. Item, I give and bequeath to my cousin JOAN HICKS her daughter thirty shillings and to my cousin MARY HICKS son twenty shillings. Item, I give and bequeath to my cousin BERSABE ANNE twenty shillings and to my three sister in laws ANNE, CHESTIAN and LUCIE HICKS, twenty shillings a piece. Item, I give and bequeath to MR. THOMAS TREWREN of Sawcrett thirty shillings being a part of the debt which he oweth unto me by his specialty or Bill and to his brother WILLIAM TREWREN thirty shillings. Item, I give and bequeath to MARGARET TREWREN widow and her son that debt which she oweth unto me by her Bill or specialty, and to my godson JOHN RANE twenty shillings. Item, I give to the men servants of Kerris between them twenty shillings and to the women servants there in like sort twenty shillings. Item, I give, devise and bequeath to my son WILLIAM HICKS all my messuages, lands, tenements, rents, reversions, services, and hereditaments whatsoever with the appurtenances situate lying and being within the parish of St. Just in Penwith and all my messuages, lands, tenements and hereditaments whatsoever with the appurtenances of and in or called Trevithall within the parish of St. Paul aforesaid which are included and expressed in the conveyance made and past from my cousin NICHOLAS LETHEBY unto my cousin RICHARD KEIGWIN to have and to hold the same unto my said son and the heirs of his body lawfully to be begotten and for want of such issue to the right heirs of me the said NICHOLAS HICKS forever. All the rest of my goods and chattels not herein given nor bequeathed I do give and bequeath equally between my wife and children and I do hereby make and ordain my wife, PHILLIP the sole Executrix of this my last Will and Testament and for overseers thereof I nominate and ordain my brother in laws WALTER BURLACE, JOHN BURLACE and my cousin HENRY HICKS to see the same truly executed, unto who, I give and bequeath for their kindness and labour in that behalf ten shillings a piece. And I do hereby charge and required my said Executrix as she will answer at the dreadful day of judgment when the secrets of all hearts shall be revealed that she carefully bring up my children in leadings and in the true form of God as much as in her consisteth and that she truly in all points fulfil and accomplish this my last Will and Testament without any wresting, misconstruction or mistaking of the plain sense true intent or meaning thereof and that she take no forfeiture of any Bill, bond, specialty or writing whatsoever but only the principal with the charge of law if any be laid out in prosecution thereof.
