In the name of God Amen, I, THOMAS POULSUM the Elder of Whitley in the Parish of Melksham, in the County of Wilts [sic] Yeoman, being very weak and feeble in constitution but finding my dissolution approaching near at hand and having my intellectual facultys [sic] in perfect vigour [sic] thanks be to God, do make, publish and declare this to be my last Will and Testament in manner and form following.
First I give unto my wife, MARY, for and towards her maintenance and the maintenance and breeding up of my daughter, SARAH POULSUM, all my shop goods of what sort or kind soever in and about the shop in my dwellinghouse at Whitley aforesaid. Also those two boxes with such goods and linen therein as was the property of my said wife before marriage. I give and devise unto my said wife for and during so long as she shall remain my widow the free use and occupation of all that my said shop and the chamber over the kitchen in my said dwellinghouse and liberty of ingress, egress of in and to the same. I give all the remainder of my said dwellinghouse with orchards, gardens, stables, barns and outhouses with the appurtenances unto my son, James Poulsum for and during the widowhood of my said wife. And from and immediately after her decease or extinction of widowhood, I give and devise the same and also the said shop and chamber given to my said wife unto my two sons, THOMAS POULSUM and JAMES POULSUM, their Executors, Administrators and assigns for and during all my estate right term and terms of years yet to come and interest that I have therein. I give and devise unto my said wife and son, JAMES, all my closes, grounds, tenements and hereditaments with their and every of their appurtenances situate lying and being in the parish of Melksham, aforesaid, for and during the widowhood of my said wife and from and immediately after the determination of that estate I give and devise the same unto my said two sons, THOMAS POULSUM and JAMES POULSUM, their Heirs, Executors and Administrators for and during all my estate, right and interest therein. I give unto my said wife and son, JAMES, for and during the widowhood of my said wife all my stock of cattle, cows, sheep, horses, hay, carts and carriages except my little black colt and half a score of hog sheep now in West Leaze which I give to my said son, THOMAS POULSUM, to be delivered to him ad Midsummer next old stile [sic] and also except my little grey mare and side saddle and bridle which I give unto my said wife. I give and devise unto my mother, MARY POULSUM, widow, all those my closes, grounds, lands, hereditaments and premises with their appurtenances situate lying and being at Atford in the said County of Wilts for and during her natural life and from and immediately after her decease I give and devise the same unto my said son, JAMES POULSUM, his Heirs, Executors, Administrators and assigns for and during all my estate, right, title and interest therein. I give all my household goods and implements of household unto my said wife and son, JAMES, during the widowhood of my said wife and after the extinction of the right I give the same unto my said two sons for ever. I give unto THOMAS, the son of my said son, THOMAS POULSUM, all my wearing apparel both linen and woolen or otherwise except my two great coats and my best hat which I give to my said son, JAMES. And my Will is and I do desire my friend Mr. John Marshman will take a true inventory of all my estate, goods, chattels and real and personal estate and deliver a true copy thereof to my said son, THOMAS, to the intent that he may be ascertained of his right and property and I do charge my closes, grounds, lands and premises lying and being at Atford with the payment of one shilling per week to JANE POULSUM of Whitley during her life and I do constitute and appoint my said wife and son, JAMES POULSUM, Executors of this my last Will and Testament. IN WITNESS whereof I have hereunto set my hand and seal the twenty fourth day of May in the year of our Lord 1763 and in the third year of the reign of our Sovereign Lord George the Third, King over Great Britain, etc. My Will likewise is that my said mother shall have her residence and maintenance in and out of my said dwellinghouse during her lifetime or in neglect, denial or default thereof I charge the same with the payment of one shilling per week during her life to her.
Signed, sealed, published and declared by the Testator as and for his last Will and Testament in the presence of us who in his presence and at his request have subscribed our names as witnesses. James Poulsum, Mary Poulsum, Henry Robins.
Note: Will was signed and sealed [with was seal] by Thomas Poulsum.
[By way of Codicil signed at the time and in front of the same witnesses as the above Will the following was added:]
My Will likewise further is that whereas I have given and devised from and immediately after widowhood of my wife, MARY POULSUM, all my dwellinghouse with the orchards, gardens, barns, stables, outhouses and appurtenances situate at Whitley unto my two sons, THOMAS POULSUM and JAMES POULSUM, their Executors, Administrators and assigns and whereas I stand bound with and for my said son, THOMAS POULSUM to Arthur Gray of Melksham for forty pounds and interest which said money was received by my said son, THOMAS, therefore my Wil is that in case my said son THOMAS do no pay the interest due and to grow due in the said Bond and likewise the principal sum of forty pounds when the same shall be called in to be paid and my said Executors or either of them shall be obliged to pay the same, then I do charge the estate, lands, tenements and hereditaments by me given and devised to my said son, THOMAS, with the payment of the said sum of forty pounds and interest and all costs and charges that shall arise therefrom. And also my Will is that my said son, JAMES, shall have the great black colt anything contained in my said Will to the contrary notwithstanding. And I do direct that this be deemed part of my Will and Testament and the same being annexed to my said Will and by me signed published sealed and delivered at the same time [one or two word obliterated] before the said Witnesses [one or two words obliterated] parcel of my said Will and do declare that this is part of my Will and annexed for that purpose. As witness my hand and seal.
Signed, published, sealed and declared as and for part and parcel of the last Will and Testament of the Testator at the same time as the other part hereto annexed was executed by him in the presence of us. James Poulsum, Henry Robins.
